access conditions for
graphite industry are to protect graphite resources, optimize resource allocation, improve the comprehensive utilization of resources, guide the healthy and sustainable development of the graphite industry, and formulate the access conditions in accordance with relevant national laws and regulations and industrial policies. The term “graphite†as used in this access condition refers to: crystalline graphite (also known as flake graphite), microcrystalline graphite (also called cryptocrystalline graphite, earthy graphite) ore dressing products, as well as high-purity graphite, expandable graphite, flexible graphite, etc. Processed products.
I. Construction conditions and production layout (1) Newly built and rebuilt and expanded graphite projects must comply with national industrial policies, local industrial development plans, and overall land use planning, and coordinate the rational allocation of resources, energy, environment, safety and market. During the “Twelfth Five-Year Plan†period, based on domestic demand, we strictly controlled the increase, focused on optimizing the stock, vigorously adjusting the structure, promoting mergers and acquisitions, and improving industrial concentration. Newly built and rebuilt and expanded beneficiation projects (excluding tailings comprehensive utilization projects) must adhere to the principle of equal or reduced replacement and be linked to the elimination of backward production capacity. Encourage the construction of graphite industry clusters in resource-rich areas and industrially advantageous areas to accelerate the development of graphite processing products. (2) It is strictly forbidden to be within 1 km of the boundary of the urban planning area, and within the scenic spots, ecological protection areas, natural and cultural heritage protection areas, drinking water source protection areas, urban built-up areas and urban non-industrial planning areas. New and expanded graphite projects within the local environmental protection and safety protection limits. If the graphite project that has been put into operation in the above-mentioned areas fails to meet the relevant requirements of this access condition, it should be achieved by the end of 2014 through rectification.
2. Production scale, technology and equipment (3) Newly built and rebuilt and expanded graphite projects, encourage the use of energy-saving and environmentally-friendly technologies such as multiple crushing, grinding and short-flowing processes, and encourage the use of large-scale crushing and grinding equipment, large vertical mills, Advanced equipment such as aerated agitation flotation machine, automatic plate and frame filter press, and desulfurization calendering machine to improve automation. Newly built and rebuilt and expanded scale graphite beneficiation projects with a design scale of not less than 20,000 tons/year and a single-line scale of not less than 5,000 tons/year. Newly built and rebuilt and expanded microcrystalline graphite ore dressing project, the design scale is not less than 150,000 tons/year, the single-line scale is not less than 30,000 tons/year, and the ore recovery rate is not less than 85%. (4) Newly built and rebuilt and expanded high-purity graphite projects, adopting advanced technology routes of energy conservation and environmental protection, the scale is not less than 5,000 tons/year, and the finished product rate is not less than 85%. Newly built and rebuilt expansion of expandable graphite project, using electrolytic oxidation process or strong acid impregnation process route, the scale is not less than 5,000 tons / year, the yield rate is not less than 95%. Newly built and rebuilt and expanded flexible graphite project, using continuous expansion and calendering molding process and equipment, the equipment width is not less than 1000 mm, the scale is not less than 1000 tons/year, and the finished product rate is not less than 90%. (5) If the existing ore recovery rate or finished product rate of the existing graphite project does not meet the above requirements, it shall be reached before the end of 2014 through technical transformation.
Third, product quality (6) The quality of graphite products is in compliance with relevant standards by third-party testing institutions. The flake graphite and high-purity graphite meet the requirements of GB/T 3518 “Flake Graphiteâ€. The microcrystalline graphite meets the requirements of GB/T 3519 “Microcrystalline Graphiteâ€, the expandable graphite meets the requirements of GB/T 10698 “Expandable Graphiteâ€, and the flexible graphite reaches JB/T 7758.2 "Technical Conditions for Flexible Graphite Sheets". (7) Equipped with product performance inspectors, inspection laboratories and necessary testing equipment to establish a sound quality management system.
4. Energy, water resource consumption and comprehensive utilization (8) Newly built and rebuilt and expanded graphite projects, the comprehensive energy consumption of products meets the following standards: 1. Flake graphite: According to the average grade of raw ore, the following indicators are met:

Microcrystalline graphite: not higher than 100 kg standard coal / ton; 3. high purity graphite: not higher than 400 kg standard coal / ton; 4. expandable graphite: not higher than 500 kg standard coal / ton; Flexible graphite: no more than 700 kg of standard coal / ton. If the comprehensive energy consumption of existing graphite project products is higher than the above standards, the technical transformation shall meet the requirements before the end of 2014. (9) Energy conservation assessment and review shall be carried out for the construction and reconstruction of graphite projects. Enterprises that consume more than 5,000 tons of standard coal annually should submit an annual report on energy use, including energy consumption, energy use efficiency, energy conservation goals, energy efficiency analysis, and energy conservation measures. (10) Newly built and renovated and expanded graphite projects, water resources should be recycled. The water recycling rate of the flake graphite beneficiation process is not less than 90%. The water recycling rate of high-purity graphite and expandable graphite process is not less than 80%. If the existing water consumption rate of the graphite project does not meet the above standards, it shall meet the requirements by the end of 2014 through technical transformation. (11) Encourage the comprehensive utilization of tailings resources and vigorously develop circular economy.
V. Environmental Protection (12) Newly built and rebuilt and expanded graphite projects Strictly implement the environmental impact assessment system and the “three simultaneous†system to control the total amount of pollutants and prohibit excessive discharge. (13) Key tobacco and dust generation processes for raw material transportation, crushing and drying, equipped with dust suppression and dust removal facilities. After treatment, the flue gas and dust-containing gas meet the requirements of GB 9078 “Industrial Kiln Air Pollutant Discharge Standardâ€, GB 16297 “Integrated Emission Standard for Air Pollutants†or the environmental standard of the project location. (14) Use low-noise equipment, set sound insulation barriers, etc. for noise control, and the noise complies with GB 12348 “Environmental Noise Emission Standards for Industrial Enterprises Boundaryâ€. (15) For the production of high-purity graphite by chemical method, the corresponding wastewater treatment facilities shall be constructed, and the wastewater discharge shall reach GB 8978 “Integrated Wastewater Discharge Standardâ€. (16) Regularly carry out clean production audits, establish an environmental management system, and formulate comprehensive emergency response plans for emergencies.
VI. Safety Production, Occupational Health and Social Responsibility (17) Newly built and rebuilt and expanded graphite projects shall be constructed in accordance with the provisions for safe production and occupational hazard prevention and control facilities, and shall be designed, constructed and put into use simultaneously with the main project to establish a safety production responsibility system. Obtain a safe production license. (18) The new tailings project of graphite project should meet the requirements of environmental protection, dam construction at one time, and support online monitoring device. Reconstruction and expansion of graphite projects should rectify the original tailings ponds according to regulations and formulate tailings pollution prevention and control plans. If the existing graphite project tailings pond does not meet the specified requirements, it should be rectified before the end of 2014. (19) Paying taxes according to law, not paying employees' wages, extracting and using enterprise safety production expenses according to regulations, and paying pension insurance, medical insurance, work injury insurance, unemployment insurance, maternity insurance premium and housing accumulation fund in full. (20) Carry out safety production standardization and establish an occupational health and safety management system.
VII. Supervision and Management (21) New and rebuilt and expanded graphite projects shall meet the conditions for access. The investment in the graphite project, land supply, environmental assessment, safety production supervision, energy conservation assessment, credit financing and other management must be based on this access conditions. (22) Before the project is put into production and during the production operation period, the local industrial authorities shall supervise and inspect the conditions of the graphite enterprises in the jurisdiction to implement the access conditions. (23) The Ministry of Industry and Information Technology announces the list of graphite production enterprises that meet the requirements for access, accepts social supervision and implements dynamic management. The management of the announcement shall be separately formulated by the Ministry of Industry and Information Technology. Relevant industry associations and intermediaries should publicize and implement the national industrial policy, strengthen industry self-discipline, and assist in the supervision of the industry.
8. Supplementary Provisions (24) These access conditions apply to all graphite production enterprises within the territory of the People's Republic of China (excluding Taiwan, Hong Kong and Macao). (25) The laws, regulations, standards and related policies and related policies involved in this access condition shall be implemented in accordance with the latest version. (XXVI) The access conditions shall be implemented as of January 1, 2013, and the Ministry of Industry and Information Technology shall be responsible for the interpretation and organization of the amendments.
